Welcome to Screenmarks. By accessing or using our service, you agree to be bound by these Terms of Service. Please read them carefully before using our platform.
By creating an account or using Screenmarks, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use our service. We may update these terms from time to time; continued use after changes constitutes acceptance.
To use Screenmarks, you must create an account with accurate information. You are responsible for maintaining the security of your account credentials and for all activities under your account.
You must be at least 13 years old to use this service. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these terms.
Screenmarks provides a screenshot management platform that includes:
Features and availability may vary by subscription tier. We reserve the right to modify, suspend, or discontinue any feature at our discretion.
Payment Processing: All payments are processed by Creem as the Merchant of Record. By completing a purchase, you agree to Creem's terms of service. Creem handles all payment processing, currency conversion, and sales tax/VAT collection on our behalf. We do not store your payment details.
Free Trial: New users receive a 7-day free trial with 50 processing credits. No payment information is required to start the trial.
Paid Plans: After the trial, continued access requires a paid subscription (Basic, Plus, or Pro). Prices are as displayed at time of purchase. All prices are exclusive of tax; applicable taxes are calculated and collected by Creem at checkout.
Billing: Subscriptions are billed monthly or annually in advance. By subscribing, you authorize recurring charges to your payment method through Creem until you cancel.
Credit Packs: Processing credit packs are one-time purchases that add credits to your account. Credit pack purchases are non-refundable once credits have been used.
Cancellation: You may cancel your subscription at any time through your account settings. Your access continues until the end of your current billing period. After cancellation, your account reverts to the free tier and you can still view your existing screenshots.
Refunds: We do not provide refunds for partial billing periods. If you believe you were charged in error, contact us at support@screenmarks.com within 14 days of the charge. Creem, as Merchant of Record, may also issue refunds independently when required by applicable law or card network rules.
Price Changes: We may change prices with 30 days' notice. Price increases take effect at your next renewal. You will be notified by email before any price change applies to your subscription.

Your Content: You retain ownership of all screenshots and notes you upload. By using our service, you grant us a limited license to store, process, and display your content solely to provide the service.
Our Platform: Screenmarks, including our software, design, branding, and documentation, is our intellectual property. You may not copy, modify, or redistribute our platform without permission.
Your data is handled in accordance with our Privacy Policy, which explains how we collect, use, and protect your information. By using Screenmarks, you consent to our data practices as described in that policy.
We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or face outages beyond our control. We are not liable for any damages resulting from service interruptions.
SCREENMARKS IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
IN NO EVENT SHALL SCREENMARKS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You may terminate your account at any time through your account settings or by contacting us. We may terminate or suspend your account for violations of these terms or for any reason with reasonable notice. Upon termination, your right to use the service ends, and your data may be deleted in accordance with our Privacy Policy.
These Terms are governed by the laws of the jurisdiction where Screenmarks operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
